Rep. Roy leads legislation to curb illegal migration at our border

May 13, 2022

*** UPDATE: Rep. Roy reintroduced this bill in January 2023 as H.R. 29 for the 118th Congress. More information about the legislation can be found here.

WASHINGTON — On Friday, Rep. Roy (TX-21) was joined by 16 Republican colleagues in introducing the “Border Safety and Security Act” to force DHS to control the flow of illegal migration at our southern border and ensure U.S. immigration laws are enforced.

The Border Safety and Security Act would empower the Department of Homeland Security (DHS) to turn away illegal migrants at the border if the Secretary of DHS does not have operational control – as required by law.

"The only metric for any border policy right now is whether it will stop the flow of illegal migrants. That's it," Rep. Roy said of the bill. "Secretary Mayorkas has been allowing asylum to be the exception that swallows the rules of border security — leading to chaos and crises at our border. Congress needs to step in and require DHS to turn people away if the department can’t abide by our laws and certify that all aliens claiming asylum are being detained for the adjudication of their claims.”

The bill would also require DHS to use this authority when undocumented migrants cannot be detained as required by current law or be placed in a program consistent with Migrant Protection Protocols (“Remain in Mexico”).
