Rep. Roy disagrees with SCOTUS decision on proxy voting suit

January 24, 2022

Rep. Chip Roy (TX-21) issued the following statement Monday following the Supreme Court's decision not to grant certiorari in the suit he is leading alongside Minority Leader Kevin McCarthy (CA-23) challenging the constitutionality of proxy voting in the House of Representatives:

The Supreme Court should have granted certiorari for this case because of the ongoing damage this blatantly unconstitutional scheme is doing to the House as an institution and our constitutional order as a whole. While I believe strongly that Congress should indeed police itself, when it refuses to do so, the checks and balances of the other branches are supposed to come into play.

This case raises the important question of the Constitutionality of roughly 18,000 proxy votes cast by Members of Congress. We as members of this body have the duty and responsibility to our Constitution not to circumvent it, especially for mere personal convenience. Furthermore, the legislative process cannot properly be performed by proxy; we have a moral duty to the Americans we represent to actually show up for work and deliberate the issues affecting them in person.

I applaud Leader Kevin McCarthy for his personal dedication in joining with me in fighting to restore the People's House, and I look forward to ending this unconstitutional absurdity completely when Republicans retake the majority.
